While at the Wellspring Resource Center in Ohio just recently, I
received the following facsimile transmission:

(Special note: My brother Atty John F. Padgett wrote a check for $10,000
in July of 1998, and $11,835.95 in December of 1999.  These total
$21,835.95.  Both checks were cashed by officers of the court
immediately and cleared the banks right away.)

This fax is vital exculpatory evidence. On January 19, 1999, Judge
Boteler ruled that I owed $21,835.95 in back child support (arrears)
WITHOUT any evidentiary hearing, discovery,and statutory application of
income grids -only allegations of hearsay and obiter dictum. This Order
was appealed and the ruling came back from the higher court that error
had occurred in that finality language was not used - therefor only
interlocutory.

On October 30, 2000 the Criminal Court "re-convicted" me
stating that the arrears has not or never been paid down and has
increased since the 1998 indictment thus evidence of neglect and
non-compliance to a diversionary plea agreement.  This was also stated
as fact in the local KY newspaper on November 10, 2000.

The above fax PROVES BEYOND A REASONABLE DOUBT that I am completely
innocent of these recent charges and that they are FALSE and were
covertly TRUMPED UP.

Attn: O.S.A.  Are you reading this John Carmichael and Frank Ofman? Your
OP worked but didn't go unnoticed.
